{"id":2112,"date":"2011-03-22T07:39:55","date_gmt":"2011-03-22T14:39:55","guid":{"rendered":"http:\/\/eaf.net\/mvp\/?p=2112"},"modified":"2012-04-03T21:04:07","modified_gmt":"2012-04-04T04:04:07","slug":"sharia-in-florida","status":"publish","type":"post","link":"https:\/\/www.eaf.net\/mvp\/2011\/sharia-in-florida\/","title":{"rendered":"Sharia in Florida?"},"content":{"rendered":"<p>Is this a legitimate use of Islamic law in a US civil court?<\/p>\n<p>Is this anything to be alarmed about?<\/p>\n<p>Is this precedent setting?<\/p>\n<blockquote><p>The question of what law applies in any Florida courtroom usually comes down to two choices: federal or state.<\/p>\n<p>But Hillsborough Circuit Judge Richard Nielsen is being attacked by conservative bloggers after he ruled in a lawsuit March 3 that, to resolve one crucial issue in the case, he will consult a different source.<\/p>\n<p>&#8220;This case,&#8221; the judge wrote, &#8220;will proceed under Ecclesiastical Islamic Law.&#8221; <!--more--><\/p>\n<p>Nielsen said he will decide in a lawsuit against a local mosque, the Islamic Education Center of Tampa, whether the parties in the litigation properly followed the teachings of the Koran in obtaining an arbitration decision from an Islamic scholar.<\/p>\n<p>The suit was filed by several men who say they were improperly ousted as trustees in 2002. The dispute may decide who controls $2.2 million the center received from the state after some of its land was used in a road project.<\/p>\n<p>But attorney Paul Thanasides last week appealed Nielson&#8217;s decision with the 2nd District Court of Appeal, saying religion has no place in a secular court.<\/p>\n<p>His client: the mosque.<\/p>\n<p>[&#8230;]<\/p>\n<p>The judge said he would use Islamic law to decide only the legitimacy of arbitration.<\/p>\n<p>&#8220;What law would we be applying (at) trial?&#8221; Thanasides asked.<\/p>\n<p>&#8220;That trial would be civil law,&#8221; the judge said. &#8220;Florida law.&#8221;<\/p><\/blockquote>\n<p>Is that all there is to it?<\/p>\n<p>Might this be a test to see whether &#8220;they&#8221; can &#8220;get away&#8221; with it?<\/p>\n<p>I don&#8217;t know.<\/p>\n<p>But I find the matter interesting.<\/p>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>Is this a legitimate use of Islamic law in a US civil court?
